Rajya Sabha MP and Bharatiya Janata Party (BJP) leader Sushil Kumar Modi said in Parliament on Monday, December 19, that legal recognition of same-sex marriage in India is "a delicate balance of personal law in the country. It would be a complete disaster."
What was the big deal said?
During Zero Hour he said, "Marriage in India is a sacred thing, and a relationship between a biological male and a biological female. It is an age-old ritual and part of our social fabric. In India, same-sex Marriage is governed by any uncodified personal laws… or is neither recognized nor accepted in any codified statutory laws."
The Supreme Court on 25 November issued notices to the Center and Attorney General R Venkataramani on two petitions by same-sex couples seeking recognition under the Special Marriage Act. The Center was given four weeks to respond.
At least nine petitions seeking recognition of same-sex marriages under the Special Marriage Act, the Foreign Marriage Act and the Hindu Marriage Act are currently being heard in the Delhi High Court and the Kerala High Court.
Earlier, in November, the Center told the Kerala High Court that it was taking steps to transfer all writ petitions to the Supreme Court.
What else did Sushil Modi say?
Accusing "left-liberal democrats and activists" of trying to legalize same-sex marriage "to woo Western countries", the BJP MP said.
"Same-sex marriage will create complete havoc with the delicate balance of personal laws in the country. Family, children, adoption, domestic violence, divorce, wife's right to reside in the matrimonial home - all these are linked to the institution of marriage."
Sushil Modi argued that the recognition of gay marriage should not depend only on the decision of two judges. He said, "There should be a debate on this in the Parliament and in the public sphere…I urge the Government of India to strongly oppose same-sex marriage. I also urge the judiciary not to take such a decision which violates India's cultural heritage." Be against the ethos and social beliefs.
In 2018, the Supreme Court, in a historic decision, had declared Section 377 as non-criminal considering sexual autonomy as a basic right.
